Can I charge an NDIS participant more than other customers?
Not without a reasonable justification. A provider must not charge a higher price for goods or services supplied to an NDIS participant than the price it charges a person who is not a participant, unless the higher price is reasonable and can be justified.
Answered from the held text of NDIS Code of Conduct s6-2. The clause behind it is cited below, and the requirement page carries the evidence an assessor asks for.
What the clause behind this answer says
s6-2 No higher price for goods supplied to NDIS participants without reasonable justification
Without a reasonable justification, a person the Code covers must not state (s 6(2)(a)) or charge (s 6(2)(b)) a higher price for goods supplied to a participant than it states or charges for the same goods, or goods that are substantially the same, to someone who is not a participant. Added from 19 December 2023. The prohibition covers goods, not services; a provider that relies on a reasonable justification for a difference should be able to show what it was.

What evidence answers it
- Price list or point-of-sale records showing the same price for NDIS and non-NDIS customers for each product
- Written justification for any price difference (extra delivery, fitting or assessment work) kept with the quote or invoice
- Review of website and quote templates confirming no NDIS-only price tiers
What assessors commonly find
- Quotes that ask whether the customer is an NDIS participant and then add a loading
- Price differences justified after the event rather than documented at the time
- Online stores showing a higher price when an NDIS number is entered
