When must I notify the Commission of a change of ownership?

A registered provider must notify the Commissioner of a significant event, including a change of ownership, before it happens. The notice is given in the approved form, and a change of ownership also brings an audit of the provider within three months of the change.

Answered from the held text of NDIS Provider Registration Rules s13A. The clause behind it is cited below, and the requirement page carries the evidence an assessor asks for.

What the clause behind this answer says

s13A Notify significant events, including a change of ownership before it happens
The provider tells the Commissioner, using the form the Commissioner approves, about: an event that has a significant effect on its ability to meet its conditions; a change that harms the access people with disability have to the supports it is registered to provide; a decline in its financial capacity; a major change to its organisation or its governance; and events that bear on whether it or its key personnel remain suitable (the matters in ss 9(2)(c) to (h) and 10(2)(b) to (g)). Where ownership of the provider, or of its business, changes and that brings a governance change, the notice is due by the earlier of when it learns the change will happen and any step that must come first to bring the change about (s 13A(3), from 1 July 2026); other notices by the earlier of awareness and occurrence.

s13BA Change of ownership audit within 3 months (from 1 July 2026)
Where a certification-assessed provider goes through a major change to its organisation or governance because ownership changes for the provider, or for a business it runs, and in the next three months it has no mid-term audit underway and its registration does not end, it goes through a certification audit that starts within 3 months of the change (or later if the Commissioner allows), against the Part 3 Core module standards and any standard that had a corrective action plan; the auditor reports to the Commissioner within 28 days of finishing it. This applies to changes of ownership from 1 July 2026.
