NDIS Code of Conduct
Part 2: The NDIS Code of Conduct (section 6)
s6-1-f Prevent and respond to violence, exploitation, neglect and abuse
Clause and reference s 6(1)(f) of the NDIS (Code of Conduct) Rules 2018 · our reference s6-1-f
The requirement
Everyone the Code covers does what is reasonably necessary to prevent violence, exploitation, neglect and abuse directed at people with disability, and to answer it when it happens. For providers this includes a stated commitment to eliminating such harm, identifying and responding to incidents and reporting them to the NDIS Commission (registered providers under the reportable incident rules) and to police or other authorities as appropriate, and reducing and eliminating restrictive practices.
Our wording of the requirement: our statement of what the clause asks, not the instrument verbatim. Source: NDIS Code of Conduct on the compliance desk.
The evidence to bring
- Safeguarding policy covering recognition, response and reporting of abuse, neglect, violence and exploitation
- Reportable incident notifications to the NDIS Commission with timestamps, and police report references where relevant
- Training records on recognising abuse and neglect for every worker
- Restrictive practice register and behaviour support plans where restrictive practices are used
What assessors commonly find
- Financial exploitation by workers (borrowing money, using participant cards) not recognised as abuse
- Incidents handled internally without notifying the Commission or police
- Unauthorised restrictive practices such as locked doors treated as routine
