NDIS Code of Conduct

Part 2: The NDIS Code of Conduct (section 6)

s6-1-g Prevent and respond to sexual misconduct

Clause and reference s 6(1)(g) of the NDIS (Code of Conduct) Rules 2018 · our reference s6-1-g

The requirement

Everyone the Code covers does what is reasonably necessary to prevent sexual misconduct and to answer it when it happens, which the guidance reads broadly (any act, gesture or comment of a sexual nature directed at or made in the presence of a person with disability, including grooming). Providers set clear boundaries for worker behaviour, screen and supervise, and operate effective processes for receiving, responding to and reporting allegations.

Our wording of the requirement: our statement of what the clause asks, not the instrument verbatim. Source: NDIS Code of Conduct on the compliance desk.

The evidence to bring

  • Professional boundaries policy defining sexual misconduct and grooming, signed by each worker
  • Allegation response procedure with reporting to police and the NDIS Commission
  • Records of each allegation, immediate safety actions taken and investigation outcome
  • Supervision arrangements for one-to-one supports in private settings

What assessors commonly find

  • Boundary breaches (personal messaging, gifts, meeting participants outside work) not treated as warning signs
  • Allegations investigated by the accused worker's line manager alone
  • Participants not told how to report sexual misconduct safely
